Tenants and Water Charges 

Most tenants in NSW pay for water usage if their premises are separately metered.

As of 31 January 2012, tenants only have to pay for their water use if the landlord has installed water saving devices.
These are:
** showerheads with a maximum flow rate of 9 litres per minute;
** all internal cold taps and single mixer taps for kitchen sinks or bathroom hand basins, must have a maximum flow rate of 9 litres per minute;
** there must be no leaking taps at the beginning of the tenancy, or when the water efficiency measures are installed, whichever is the latter.

Taps and showerheads having a maximum flow rate of 9 litres per minute have a 3 star water efficiency rating.

Paying for water

The landlord must give the tenant a copy of the water authority bill, which sets out the charges, or other evidence of water usage of the tenant. No less than 21 days must be given to the tenant for payment of the water charges.

If the landlord fails to request payment from the tenant within 3 months of issue of the bill, the tenant is not required to pay.

If a landlord receives any rebate in respect of water usage charges payable by the tenant, the tenant must receive the benefit or an equivalent of that rebate.
